On June 3, 2024, new gun laws took place here in Texas according to KVUE. A temporary injunction has been lifted, allowing a new federal gun law to take effect, which expands background check requirements for gun purchases. The law was previously blocked by a lawsuit filed by Texas Attorney General Ken Paxton and several other states in May.
WHAT DOES THE NEW LAW MEAN FOR TEXAS?
The states claimed that the new rules, which would require background checks on buyers at gun shows and other non-traditional locations, violate citizens' constitutional rights. The rule aims to reduce gun violence and close a loophole in the existing system. Over 20 Republican attorney generals filed a lawsuit in federal court to avoid any type of enforcement of the rules. Individuals stress that the rule violates the Second Amendment of the United States Constitution and that Joe Biden should not have the authority over it. Matthew Kacsmaryk, who is the US District judge and also appointing the former president Donald Trump came before the rule was even in effect and found it to be highly problematic for multiple reasons.

Kacsmaryk felt this would force individuals who are arms sellers to prove innocent rather than to prove the guilt of an individual. President Biden felt like this would keep the guns out of domestic abusers and even felons, but Matthew says since taking the bench he has ruled against Biden’s administration on several issues, including immigration and also the LGBT community protections.
