Things are about to get real ugly in the Raymond household. Usher's ex-wife, Tameka Foster, has filed legal documents to have primary custody of the couple's two children in light of a swimming pool accident in which their son, Usher Raymond V, nearly drowned.

Foster's lawyer, Angela Kinley, filed court papers at a Fulton County, Ga., courthouse on Tuesday (Aug. 6). The documents state that "the children are at risk while in the care of third-party caregivers...while (Usher) travels around the world for his work-related activities."

His ex-wife wants a judge to award her primary custody of their two children. An emergency hearing has been set for Aug. 9.

On Monday (Aug. 5), Tameka and Usher's 5-year-old son, Usher Raymond V, was rushed to the hospital after almost drowning in a backyard pool. Apparently, the young child was trying to get a toy that was caught in a pool drain and his arm got stuck while he was underwater.

Two male contractors working inside the house at the time rushed to the boy's aid and performed life-saving CPR.

TMZ released the chilling 911 call. The audio reveals that Usher's aunt, Rena Oden, was unable to free the child and that two men working on the house managed to bring him to the surface and perform CPR, which got him breathing again.

During the call, you can hear a child in the background, presumably, Raymond V's younger brother, Naviyd Raymond, saying his older brother is faking his injury. Rena immediately corrects him and says he's not faking.

According to gossip blog Straight From the A, Raymond V is recovering.

"My sources have confirmed that Lil Cinco [nickname for Usher Raymond V] is doing fine," the blogger writes. "He's currently in stable condition at Children's Healthcare of Atlanta Scottish Rite and is being held for observation."

We wish Lil Cinco a speedy recovery.
